In New York City, small claims cases are heard in City Civil Court, where the small claims dollar limit is $5,000. Only individuals may sue (except in Nassau and Suffolk Counties, where a partnership may also sue). The statute of limitations for claims involving written or oral contracts is 6 years; the statute for disputes regarding personal injury and property damage is 3 years. The parties involved may appear with or without an attorney.
